On September 28, 2012, ADEQ issued a Temporary Individual APP to Curis Resources (Arizona) Inc., to operate the Production Test Facility at the site historically known as the Florence Copper Project. ADEQ hereby makes this notice of permit issuance pursuant to Arizona Administrative Code (A.A.C.) R18-9-A210.

Curis submitted an application for a temporary individual APP to ADEQ on March 6, 2012. The purpose of this APP is to allow Curis to conduct a 14-month pilot test for in-situ recovery in order to develop data needed to support potential full-scale commercial in-situ mining operations for the Florence Copper Project.

Under ADEQ’s Temporary APP program, the permit required for any facility with the potential to discharge to groundwater must make four equally important demonstrations to the Department to receive the permit: (1) compliance with Arizona aquifer water quality standards at a point of compliance; and (2) the facility must be designed and operated to achieve the greatest degree of discharge reduction achievable through the application of Best Available Demonstrated Control Technology (BADCT); (3) financial capability; and (4) technical capability.

A public hearing will be held at Florence High School, 1000 S. Main St., Florence, AZ, 85132, on Wednesday, December 5, 2012, from 6:00 p.m. to 8:30 p.m. The purpose of the public hearing is to allow the public to make comments for the record. ADEQ will respond in writing to all comments submitted during the formal public comment period.

This public notice provides information to help you participate in the decision-making process. You have an opportunity to submit written comments on this permit. Everyone commenting will receive a “Summary Response to Comments” and notification as to whether the permit will remain as issued, or will be amended or revoked.

ADEQ may accept appeals arising from the decision to issue, modify, or revoke a Temporary Individual Aquifer Protection Permit to the Florence Copper Project, Production Test Facility, following the issuance of the Summary Response to Comments for that Permit. Appeals must comply with the requirements set out in A.R.S. 41-1092.03(B).

The public comment period is in effect from October 25, 2012 to December 23, 2012. Persons may submit comments on the proposed action, in writing, to Richard Mendolia, Project Manager, ADEQ, Groundwater Section, 1110 W. Washington St., MC5415B-3, Phoenix, AZ 85007, via email rjm@azdeq.gov, within sixty (60) days from the date of this notice. Comments must be received by the close of business on December 23, 2012.
